The Legal Process for Employment Claims

When you firmly believe that your employer has broken the law or gave you an unfair treatment or action, you can decide to take your employer to a court called the employment tribunal. An employment law solicitor in London will be on hand to help you through the process. This employment lawyer will study your case thoroughly, consider all angles, and promptly discuss with you the merits of your case. If you win your case, the tribunal which is an independent body that interprets the law can mandate your employer to pay you compensation and other applicable damages if any. An employment law solicitor in Manchester will advise you to file your case at the tribunal within three months after your employment has been terminated.

Your filing of a complaint or claim to the tribunal starts by you completing and filling out the claim form called ET1. There is a hard copy of this available and an online version. It is important to have a legal adviser when accomplishing this claim form. This form contains your claim statement. It is also the first document that the court will read and study. The employer you are complaining against will also get a copy of your claim form, and has several days to respond to your complaint via the corresponding ET3 form. When the tribunal receives this, it will also send out a copy to you, the claimant.
